Vinyasun has made the decision to close access to its sales partner program. We have made the determination that only independent individual sales partners and direct hires are qualified under Florida law to be sales representatives for our company.
Florida Statutes 489.105 (6) Defines “Contracting” as means, except as exempted in this part, engaging in business as a contractor and includes, but is not limited to, performance of any of the acts as set forth in subsection (3) (a-q) which define types of contractors. The attempted sale of contracting services and the negotiation or bid for a contract on these services also constitutes contracting. If the services offered require licensure or agent qualification, the offering, negotiation for a bid, or attempted sale of these services requires the corresponding licensure.
Joint venturer or Sales organization dealer agreements partnerships, in our opinion, constitute a Business organization which requires a primary qualifier with the Department.
Section (13) “Business organization” means any partnership, corporation, business trust, joint venture, or other legal entity which engages or offers to engage in the business of contracting or acts as a contractor as defined in this section.
For those holding professional licenses, such as realtor, construction, or home builders and remodelers who act as marketing agents to refer clients to Vinyasun this does not affect your current or ongoing agreements.
